Terms and Conditions

Chapter 1 General Provisions

Article 1 [Purpose)

These Terms and Conditions are intended to determine the basic stipulations regarding the terms and procedures for the use of the service between the Ulsan Metropolitan Government Office (hereinafter referred to as "City Hall") and those who wish to use the City Hall Internet Service (hereinafter referred to as the "Service").

Article 2 (Definitions)

The definition of the terminology used in these Terms and Conditions is as follows:

  • 1. Customer (User): Members and non-members who access the service and use (receive) the service provided by the City Hall
  • 2. Non-members: those who use the services provided by the City Hall without registration
  • 3. ID (Identification Number): A combination of English letters and alphanumeric characters selected by the user and approved by the City Hall for the purpose of identifying the member and using the services for members (only one ID is issued and available to one user)
  • 4. PW (PASSWORD): A combination of English letters and alphanumeric characters set by the user himself to protect the member's information
  • 5. Termination of service: Indication that the city hall or member terminates the contract after using the service
Article 3 (Specification and Revision of the Service Terms and Conditions)
  • ① The contents of these terms and conditions, the name of the institution, address, telephone number, fax number, e-mail address, and the person in charge of personal information protection office will be posted on the initial screen of the service so that the customer can easily know. However, the contents of the terms and conditions can be viewed by the customer through the connection screen.
  • ② These Terms may be amended to the extent that they do not violate relevant laws such as the “Act on the Consumer Protection in Electronic Commerce, etc.,” the “Act on the Regulation of Terms and Conditions,” the “Digital Signature Act,” the “Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.,” the “Law on Door-to-Door Sales, etc.” and the “Framework Act on Consumers.”
  • ③ ③ When revising these Terms and Conditions, the date of application and the reason for the revision shall be specified and announced on the initial screen of the service along with the current terms and conditions from 7 days prior to the effective date until the day before the effective date. However, if the content of the Terms and Conditions are changed in a way that is disadvantageous the customer, the company shall notify the customer at least 30 days in advance. In this case, the contents before and after the revision shall be clearly compared and displayed for easy understanding by the customer. g.
Article 4 (Application of the Terms and Conditions)
  • ① The use of the service shall be in accordance with these Terms and Conditions, and matters not specified in these Terms and Conditions shall be subject to the relevant laws and case-by-case use agreements (such as detailed agreements).
  • ② The case-by-case use agreements (such as detailed agreements) set forth in paragraph 1 cannot infringe on the interests of the customer or define unfair content.
 

Chapter 2 Service Use Agreement

Article 5 (Establishment of Use Agreement)

The use agreement shall be established in accordance with the contents of the user's Terms and Conditions and with the use approval of the City Hall for the user's application for use.

Article 6 (Application for Use)

Customers shall apply under their real name through the member information screen of the service, by recording their personal information on the application form required by City Hall.

Article 7 (Approval of Application for Use)
  • ① The City Hall shall accept the application for use of the service unless there are special circumstances in the case of an application for use by accurately stating the details set forth in Article 6.
  • ② The City Hall may limit the use of some services or withhold the approval until the reasons for the application are resolved in the following cases.
    • 1. When the contents are found to be false (name, non-real name, theft of social security numbers, etc.) or there are reasonable reasons to suspect so.
    • 2. When the City Hall deems it necessary for other public interest reasons
  • ③ The City Hall may reject the application for use in the following cases.
    • 1. When not applying with a real name
    • 2. When applying using someone else's name
    • 3. When applying for the purpose of undermining the well-being order or morals of society
    • 4. When other application requirements for use set by the City Hall are not met
Article 8 (Provision and Use of Mileage Points)

The City Hall may grant certain mileage points depending upon the membership application and activities on the website, and will notify or post separate notices about the criteria for earning and using the mileage points. However, if it is determined that the mileage points obtained in unusual manners, the City Hall may notify the customer and reduce the mileage points earned abnormally

 

Chapter 3 Rights and Obligations of the Contracting Parties

Article 9 (Obligations of City Hall)
  • ① The City Hall shall allow members to use the service on the commencement date of the service requested by the member unless there are special circumstances.
  • ② The City Hall shall deal with any opinions or complaints raised by the customer immediately if it is deemed to be justified. However, if it is difficult to process the matter immediately, the customer shall be notified of the reason and processing schedule in writing or by telephone.
  • ③ In the event of damage to the member due to the service provided by the City Hall, the City Hall shall be liable only if such damage is caused by the willful negligence or gross negligence of the City Hall, and the scope of the liability shall be limited to normal damages.
  • ④ In order to provide continuous and reliable service, the City Hall shall repair or restore them without delay in the event of a failure or loss of facilities. However, in the event of natural disasters, emergencies or other unavoidable circumstances, the service may be suspended temporarily or suspended.
  • ⑤ The City Hall shall endeavor to provide convenience to the customer in the procedures and contents of the agreement with the customer, such as the conclusion of the use agreement, the revision and termination of the agreement.
  • ⑥ The City Hall shall endeavor to protect the personal information of members, including member registration information, in accordance with the relevant laws and regulations. Regarding the protection of the member's personal information, it shall comply with the relevant laws and regulations and the contents set forth in Article 11.
Article 10 (Customer's Obligations and Information Security)
  • ① When a member signs up for the service, he or she shall provide complete information (hereinafter referred to as "subscription information") that matches the current facts. In addition, if there is a change in your subscription information, you shall renew it immediately. Once a member has completed the registration process for using the service, he or she will receive an ID and Password. For the management of the member's ID and Password
    • 1. If there is a problem with the use of a Password or ID without the member's approval, it shall be reported to the City Hall immediately.
    • 2. You shall definitely log out at the end of each connection.
  • ② The member shall agree not to do the followings while using the service:
    • 1. Doing harm to others (including minorities) by using illegally others' IDs, PASSWORDs, social security numbers, and impersonating others.
      • A. Misrepresenting relationships with others
      • B. Defamation by stipulating facts or false facts for the purpose of slandering others
      • C. Distributing false information for the purpose of giving property benefits to oneself or others or causing harm to others;
      • D. Interfering with the other person's daily life by continuing to reach to them with words, sounds, texts, images, or videos that cause shame, disgust, or fear.
      • E. Commercial activities using the service without the prior approval of the City Hall
      • F. Stealing and using the name of another person's information and communication service
    • 2. Posting unnecessary or unauthorized advertisements and promotions, soliciting or posting, publishing or e-mailing "spam", "charity letters", "pyramid schemes" and so on.
    • 3. Posting, publishing, or e-mailing vulgar or obscene data, text, software, music, photos, graphics, video messages and so on (the "Contents").
    • 4. Posting, publishing, or e-mailing contents that do not hold rights (including intellectual property rights)
    • 5. Posting, publishing or e-mailing software viruses to destroy, disrupt, or restrict the ability of computer software, hardware, or telecommunications equipment;
    • 6. Collecting or storing other users' personal information, such as posting, publishing, or e-mailing materials containing other computer code, files, or programs.
    • 7. Gambling or misconduct
    • 8. Distributing information that promotes or mediates fornication.
    • 9. Other illegal or unfair acts
  • ③ Members shall comply with provisions defined in these terms and conditions and the relevant laws and regulations.
Article 11 (Privacy Policy)
  • ① The City Hall shall collect information about the member through the information provided by the member when applying for use, and the member's personal information shall be used for the purpose of implementing this use agreement and providing services under this use agreement.
  • ② The City Hall shall not disclose or distribute the information of members obtained in connection with the provision of the service to a 3rd party without the consent of the person and may not be used for commercial purposes. However, this does not apply to the following cases:
    • 1. When there is a request from the relevant authorities for the purpose of investigation by relevant laws and regulations.
    • 2. When there is a request of Korea Communications Standards Commission
    • 3. When there is a request in accordance with the procedures prescribed by other relevant laws and regulations.
